Background

Since November 2025, residents living near a cabinet-manufacturing facility at 2638–2640 Topsail Road, Conception Bay South, have repeatedly reported strong paint- and lacquer-type fumes entering their homes and yards, with symptoms including headaches, nausea and eye and throat irritation. The facility and the homes around it are in the Town’s Residential Mixed (R-3) zone.

Complaints have been made to the Town of Conception Bay South, to Occupational Health and Safety, and to the provincial Pollution Prevention Division. Both provincial bodies have referred the matter to the Town. The Minister of Municipal and Community Affairs has written that the Town is the right body to address it.

What we ask

To the House of Assembly of Newfoundland and Labrador

We, the undersigned, call upon the House of Assembly to urge the Government of Newfoundland and Labrador to put public safety and health first: to investigate the emissions from this facility under the Environmental Protection Act, to require any controls necessary to stop fumes reaching neighbouring homes, and to report the results to residents.

To the Council of the Town of Conception Bay South

We, the undersigned residents, ask Council to put the safety and health of the public ahead of every other consideration in this matter: to confirm in writing the zoning status of 2638–2640 Topsail Road; to use its powers under the Urban and Rural Planning Act, 2000 and the Towns and Local Service Districts Act, 2023 to require effective emission controls at the facility; and to add an odour and fumes provision to the Noise and Nuisance By-law.

Public safety and health first. Families, children and older residents live within a few hundred metres of this facility. Whatever the zoning history, the health of the people who live here comes before the convenience of any business or the reluctance of any office to act. We ask every body that receives this petition to treat it as a matter of public safety and health and to act with the urgency that deserves.

Why this matters beyond one street. If a manufacturing use can operate in a residential zone with fumes crossing the lot line and no body will act, the same can happen on any street in the province. This petition asks the Town and the Province to apply the rules that already exist.
